Terms of Use

  HERTS GOOD CARE RECRUITMENT is an independent, organisation that promotes the raising of quality in care in the private independent and voluntary care sector in Hertfordshire. HERTS GOOD CARE RECRUITMENT’s service is available to anyone looking for care within adult social care in Hertfordshire. There are conditions of the service which these Standard Terms and Conditions set out    

 
1. General
All job vacancies accepted for publication by HERTS GOOD CARE RECRUITMENT in any of its email or online publications are accepted subject to these terms and conditions. Any other conditions proposed by the provider shall be void unless accepted by HERTS GOOD CARE RECRUITMENT in writing.
All CV requests, interviews or hiring of applicants accepted by the Herts Good Care recruitment service in any of its email or online publications are accepted subject to these terms and conditions.
 
2. Definitions- In these terms and conditions:
i) “HERTS GOOD CARE RECRUITMENT” means Hertfordshire Care Providers Association
ii) “Applicant” person placing details on the website, searching for a job
iii) “Provider” Care company seeking job applicants
iv) “Advertiser” means the provider whose opportunities job vacancies are advertised without branding
v) "Job Vacancy" means display, recruitment, online, email, mail order and classified advertising and shall include inserts, supplements and re-directed Job Vacancy; This will not include company branding name or contact details.
3. Space
All Job Vacancy are accepted subject to space being available in the Medium.
 
4. Finances
HERTS GOOD CARE RECRUITMENT reserves the right to cancel any order without liability in the event of becoming aware of any meetings of creditors, bankruptcy, liquidation proceedings, the appointment of a receiver or administrative receiver over the whole or substantial part of the Provider's assets, or any indication whatsoever of financial difficulties.
 
5. Delivery and Ownership
Materials delivered must conform to HERTS GOOD CARE RECRUITMENT’s specifications. HERTS GOOD CARE RECRUITMENT reserves the right to charge the provider for work it required to amend materials to conform to its specifications but accepts no liability for such work.
Any intellectual property rights in designs prepared by HERTS GOOD CARE RECRUITMENT shall remain the property of HERTS GOOD CARE RECRUITMENT and Job Vacancy including such designs may not be reproduced without HERTS GOOD CARE RECRUITMENT's consent.
 
6. Booking Procedures
If a Job Vacancy includes a promotion, competition or a special offer of merchandise the Advertiser must provide full details to HERTS GOOD CARE RECRUITMENT on request.
 
7. Prices and Payments terms
Prices published by HERTS GOOD CARE RECRUITMENT from time to time are subject to revision at any time and orders are accepted on the condition that the price binds HERTS GOOD CARE RECRUITMENT only in respect of the period specified in the applicable rate card.
Payments must be settled in accordance with the terms shown on the invoice, which are strictly net. In default, all outstanding transactions will become liable for immediate settlement.
Any employment arising from the use of any aspect of the Herts Good Care Recruitment service will result in a cost to be paid as per these terms and conditions.
 
8. Data Protection
The details of the applicant will be held by HERTS GOOD CARE RECRUITMENT on its computer database for use of the recruitment service. These details will be passed to providers on request, once profile has been viewed on website, CV requested and interview set up. Details will not be passed to any other third parties.
Once an applicant had found employment there profile will be removed from the HERTS GOOD CARE RECRUITMENT profile page.
 
9. HERTS GOOD CARE RECRUITMENT Liability
HERTS GOOD CARE RECRUITMENT holds no liability to the any organisations/applicants the provider may communicate, interview or begin to work with. The service is an ‘introduction, advice and interview set up’ only. HERTS GOOD CARE RECRUITMENT does not endorse any care providing company or applicant and takes no responsibility for the employing company being of good repute.
 
Except to the extent specified in paragraph 15, HERTS GOOD CARE RECRUITMENT shall not be liable for any loss or damage suffered by the Provider as a result of any total or partial failure (howsoever caused) of publication, distribution or availability of any Medium in which any Job Vacancy is scheduled to be included or for any error, misprint or omission in the printing of any Job Vacancy. In the event of an error or omission by HERTS GOOD CARE RECRUITMENT, which detracts materially from the Job Vacancy, HERTS GOOD CARE RECRUITMENT will either reinsert the Job Vacancy or relevant part of the Job Vacancy in a subsequent issue or make a reasonable refund of or adjustment to the price paid by the Provider. No reinsertion, refund or adjustment will be made for any other error or omission or where the error or omission is the result of delivery of materials which do not comply with HERTS GOOD CARE RECRUITMENT’s specifications.
 
The total liability of HERTS GOOD CARE RECRUITMENT to the Provider for any act or omission of HERTS GOOD CARE RECRUITMENT, its servants or agents relating to any Job Vacancy shall not exceed the amount of a full refund of any price paid to HERTS GOOD CARE RECRUITMENT for the Job Vacancy or the cost of a reasonably comparable further or corrective Job Vacancy. Without limiting the foregoing, HERTS GOOD CARE RECRUITMENT shall not be liable for any loss of profits or business or for indirect or consequential loss. HERTS GOOD CARE RECRUITMENT accepts no liability for the repetition of an error in an Job Vacancy ordered for more than one insertion unless notified immediately the error occurs. Complaints regarding reproduction of printed Job Vacancy must be received in writing within one calendar month of the cover date.
 
HERTS GOOD CARE RECRUITMENT accepts no responsibility for the quality of reproduction of any photograph supplied by the Provider, its agents or servants.
 
10. Cancellation or Suspension
Cancellation or suspension of an Job Vacancy by the Provider must be received in writing by HERTS GOOD CARE RECRUITMENT within the period specified by the appropriate Medium. Periods for acceptance of cancellation or suspension vary in accordance with differing production requirements.
HERTS GOOD CARE RECRUITMENT reserves the right to omit or suspend an Job Vacancy at any time for good reason, without liability to the Provider and shall notify the Provider as soon as possible. If such omission or suspension is due to the act or default of the Provider, the Advertiser or their respective servants or agents, then the Provider shall pay for the Job Vacancy in full notwithstanding that the Job Vacancy has not been published.
 
11. Providers Warranties and Indemnities
The Provider warrants that the Job Vacancy does not contravene the British Code of Advertising Practice and is not in breach of any relevant legislation, including the Equality Act 2010, the Obscene Publications Act and any other legislation or regulation, such as those relating to the provision of Financial Services, which apply to specific Advertisers, products or services.
If any Job Vacancy submitted for publication contains the name or pictorial representation (photographic or otherwise) of any living person and/or any part of any living person and/or copy by which any living person is or can be readily identified, the Provider warrants that the Provider or the Advertiser has obtained the authority of such living person to make use of such name, representation and/or copy.
 
The Provider will indemnify and hold harmless HERTS GOOD CARE RECRUITMENT from and against any claim that the Job Vacancy infringes the copyright, trademark or other intellectual property rights of any person or that it is defamatory or infringes any other right of any person. HERTS GOOD CARE RECRUITMENT reserves the right to withdraw and/or refuse to publish an Job Vacancy without liability to the Provider if it reasonably believes that the Job Vacancy may make HERTS GOOD CARE RECRUITMENT or the Advertiser liable to any complaint, claim or proceedings.
 
12. Online Job Vacancies
The Provider must complete an online form to submit job vacancies to the Herts Good Care website. All providers’ job vacancies will be free of charge. All job vacancies will be unbranded, meaning they will not contain logo, name of provider, provider contact details or application form when published on the website. Herts Good Care Recruitment will require these details for when possible employment or interested applicants is being pursued.
 
To cancel or alter an order the Provider must inform HERTS GOOD CARE RECRUITMENT by e-mail or fax to the number or address on the order, at least 2 working days before 9am on the go-live date Otherwise, HERTS GOOD CARE RECRUITMENT may not be able to achieve the specified go-live date but the Provider must pay the full amount irrespective of whether any delivery target for impressions have been met. If the Provider is supplying creative content or change of creative to be used in rotations, in the form of a redirected Job Vacancy, the Provider must inform HERTS GOOD CARE RECRUITMENT in advance. If an Job Vacancy links to another site, the Provider is responsible for maintaining the link and for the content of the linked site. HERTS GOOD CARE RECRUITMENT may remove any Job Vacancy which contains content or links to a site which, in HERTS GOOD CARE RECRUITMENT's opinion, is defamatory or objectionable or will bring HERTS GOOD CARE RECRUITMENT into disrepute. The Provider will indemnify HERTS GOOD CARE RECRUITMENT from and against any claims or liability arising from links contained in an Job Vacancy. Job Vacancy may contain only such information and code as is necessary to run the Job Vacancy effectively on the relevant HERTS GOOD CARE RECRUITMENT Site. Job Vacancy may not contain tags, cookies, beacons or similar technology which identifies users of any HERTS GOOD CARE RECRUITMENT Site or enables the Provider or any third party to serve such users with any advertising other than the Job Vacancy. If an Job Vacancy is supplied which does not comply with these terms and conditions or HERTS GOOD CARE RECRUITMENT receives complaints regarding an Job Vacancy, HERTS GOOD CARE RECRUITMENT may, at its discretion, remove the Job Vacancy from display without reference or liability to the Provider. Where an Job Vacancy is sold on a cpm basis, HERTS GOOD CARE RECRUITMENT will provide the Provider with delivery statistics and campaign reports on a regular basis throughout the campaign period. The statistics and other reports provided by HERTS GOOD CARE RECRUITMENT shall, in the absence of manifest error, be binding on the Provider and are in lieu of any other right of audit. The Provider's sole remedy if HERTS GOOD CARE RECRUITMENT or its third party subcontractors who may host and serve Job Vacancy from time to time, make an error in displaying any Job Vacancy is the cost of re-running the relevant Job Vacancy. Neither HERTS GOOD CARE RECRUITMENT nor its subcontractors shall be liable for failure to display the Job Vacancy caused by circumstances outside their control.
 
13. Response
Providers and Advertisers agree to deal fairly and professionally with individuals who may respond to a recruitment related Job Vacancy and to indemnify HERTS GOOD CARE RECRUITMENT from and against any claim brought by an individual against HERTS GOOD CARE RECRUITMENT arising from a breach of this obligation or any other of these terms and conditions.
 
HERTS GOOD CARE RECRUITMENT does not guarantee any response to recruitment related Job Vacancy or that responses will be from individuals suitable for the job advertised. It is the Providers responsibility to carry out such checks and procedures as are necessary to ensure that candidates are suitable for the job advertised and have the required qualifications and personal characteristics.
 
14. Website Use
HERTS GOOD CARE RECRUITMENT is not responsible for any information used by third parties that has been published on the HERTS GOOD CARE RECRUITMENT website after being received from the applicant.
 
15. Right to reject adverts
HERTS GOOD CARE RECRUITMENT reserves the right to refuse to create any advert it does not see fit to be published. No correspondence will be entered in to with a provider who is refused an advert.
 
16. HERTS GOOD CARE RECRUITMENT Responsibility
HERTS GOOD CARE RECRUITMENT accepts no responsibility for providers finding applicants after information has been posted on website and emailed to applicants. This is the sole judgement of the applicant.
 
17. Fraud or Death
Nothing in this Agreement shall limit or exclude any party's liability for fraud or for death or personal injury caused by the negligence, or to the extent otherwise not permitted by law.
 
18. No Warranty
HERTS GOOD CARE RECRUITMENT shall not be liable to the provider for any loss or damage incurred by the applicant or the HERTS GOOD CARE RECRUITMENT Service whether caused by provider, applicant or HERTS GOOD CARE RECRUITMENT Service under any circumstances.
 
19. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of England and the parties hereby submit to the non-exclusive jurisdiction of the English Courts.
The provider agrees at all times in its conduct of business with or on behalf of HERTS GOOD CARE RECRUITMENT strictly to comply with all applicable laws, ordinances, codes, regulations, standards and judicial and administrative orders (jointly “Applicable Laws”) relevant to its duties, obligations and performance including, without limitation, Applicable Laws related to bribery such as the United States Foreign Corrupt Practice Act and the UK Bribery Act and those enforced in the country where the Provider is resident or conducts its business.
provider and its officers, directors, employees and agents shall engage only in legitimate business and ethical practices in commercial operations and in relation to its dealings with any employee or official of a government agency or any other government owned, operated or controlled entity (including, without limitation, state run universities, hospitals and libraries), or political parties or candidates (jointly “Government Official”). Neither provider nor any of its officers, directors, employees or agents shall pay, offer, give, promise or authorize the payment, directly or indirectly, of any monies or anything of value to any commercial contact or Government Official for the purpose or intent to induce such person to use his/her authority to help the Provider, HERTS GOOD CARE RECRUITMENT, and/or any affiliate of HERTS GOOD CARE RECRUITMENT for personal gain or for that of the HERTS GOOD CARE RECRUITMENT or its affiliates (any such act, a “Prohibited Payment”). A Prohibited Payment does not include a payment of reasonable and bona fide expenditures, such as travel or lodging expenses, which are directly related to the promotion, demonstration or explanation of products or services or the execution or performance of a contract, provided that such payments are permissible under Applicable Laws. Provider further agrees not to accept any payment or other benefit in money or in kind from any person as an inducement or reward for any act or forbearance or in connection with any matter or business transacted by or on behalf of HERTS GOOD CARE RECRUITMENT
 
 
 
20. Right to reject applicants
HERTS GOOD CARE RECRUITMENT reserves the right to refuse to create any applicant profiles it does not see fit to be published. No correspondence will be entered in to with an applicant who is refused.
 

21. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of England and the parties hereby submit to the non-exclusive jurisdiction of the English Courts.
 
22. Information Sharing
HERTS GOOD CARE RECRUITMENT reserves the right to contact the relevant job centre if an applicant fails to attend a scheduled interview with a provider or is deemed to have uploaded a fraudulent profile.
23. Applicant Placements
Herts Good Care Recruitment can only find applicants for adult care providers who deliver care to 50% of their clients in Hertfordshire (not recruitment agencies). No applicants can be found and placed for care agency work employees.
 
23. Agreement
These terms and conditions are deemed to be accepted by the provider by ticking the confirmation box on the online application form.
